Limited One-Year Warranty:
This Limited One-Year Warranty (the "Warranty") is offered by Eterna LLC and applies to eBikes purchased directly from us or our authorized dealers. This Warranty covers the eBike for one year from the date of original purchase ("Warranty Period") against defects in materials and workmanship, under normal use and service.
This Warranty does not cover any problems or damage resulting from (1) accident, abuse, misuse, neglect, unauthorized modifications or repairs, (2) improper assembly or maintenance, (3) installation of parts or accessories not originally intended for or compatible with the eBike, (4) commercial use of the eBike, (5) normal wear and tear, or (6) any cause other than defects in material and workmanship.
All warranty claims must be submitted directly to us and must be accompanied by proof of purchase. The eBike or defective component should be returned to us for evaluation, freight prepaid and insured. The decision to repair or replace a defective component will be made at our sole discretion.
In the event of a defect, we will, at our option, repair or replace the defective component(s) or refund the purchase price. The foregoing remedies are the sole and exclusive remedies available under this Warranty and we are not responsible for direct, special, incidental, or consequential damages, including, but not limited to, damage to or loss of personal property or loss of use.
This Warranty gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction. Any disputes relating to this Warranty or the eBike will be governed by the laws of South Carolina and must be adjudicated in the courts of South Carolina.
